We will only use your data to inform you about activities that we think are relevant to you.

We promise to protect your data.

We will ensure the language we use is assessable and easy to understand.

How we use your information

We will only hold information which has been provided to us and has been agreed with an individual who is over 18 years of age.

We will use this data to share information about our activities or about up and coming events.

So that we can provide excellent customer service to you.

So we can contact you in emergencies.

The information you provide to us will be stored and password protected. This will only be used by key members of staff and members.

We hold this information under the new General Protection Data Regulation (GPDR) as part of our legal obligation.

Sharing your information

We will not share your information with any other third party unless we have permission. Information may be shared in the event of any Child Protection issues. This is a requirement by law, Children’s act 1989 and any amendments since. We follow appropriate safeguarding and child protection procedures.

Keeping your information

When you book online or have provided us with your details in writing then we will store your data safely and securely. If you wish to opt out of us holding your information then please email management@ultimatevisionsports.co.uk

Participants and parent’s details will be used to create registers (Hard copy) and these will be shared with the onsite coaches. This is due to Health and Safety and Child Protection procedures.

You can request to receive a copy of your information that we hold by emailing management@ultimatevisionsports.co.uk and we will provide this within 30 days, free of charge.  

The rights

You have the rights to be informed about any changes we make about your personal information, this includes any changes in law.

You have the right to access any information we hold about you.

You can request that we correct any inaccuracies we have for you and request we make any new changes in your circumstances.

You have the right to ask us to delete your information.

You have the right to complain to our data protection officer or the data protection regulator: (Information Commissioner Officer) IOC.

Any changes in protecting your privacy

If for any reason we were to change the way we store or protect your data then this will be changed in our policy and will be available on our website, we may also email, message or call you to let you know about changes we make.

Terms & Conditions

1. Definitions:

1.1  Terms and Conditions – means the terms contained in this document and any other document referred to within it.

1.2  Content - any and all of the content and material containing within the Site including without limitation all text, graphics, photographs, audio and video.

1.3   Course - Any course, activity, extracurricular activity, club or event attended by you and delivered by Ultimate Vision Sports.

1.4   Carer - the person / persons who accompanies the child to the course or any part of it.  

1.5  Parent - a parent or legal guardian who is the contracting party to this agreement.

1.6  "Ultimate Vision Sports” - the company with whom you have entered into this contract.

1.7  "Coach" means the individual(s), employed by Ultimate Vision Sports to deliver the sessions/event. 

1.8   “Assistant Coach” the individual recommended by Ultimate Vision Sports to support the Lead coach.

1.9  "Pupil" means the child attending the course, whose details are provided by the Parent or Carer on the Enrolment/Parentental Agreement Form.

1.10  User Information - the personal details which may be provided by you to us via the Site or form.

1.11  Users - the users of the Site collectively and/or individually as the setting allows.

1.12  We/our/us - Ultimate Vision Sports participants.

1.13  "Enrolment Form or Parental Agreement Form” means the form relating to the enrolment or re-enrolment of the pupil on the course.

1.14  "Fee" means the cost in sterling per course as specified on the enrolment form/Website/Flyer.

1.15  Website - a site on the World Wide Web.

1.16  you/your - you, the user.

1.17  "Premises" means the premises/Venue where the Course takes place

1.18  "Terms" means the terms and conditions set out in this document and any special terms and conditions agreed in writing by Ultimate Vision Sports and the parent.

1.19  The title "Ultimate Vision Sports” where used in this document refers to the company name.

Whilst every effort will be taken to maintain the consistency of the Coaches during the Course, Ultimate Vision Sports unreservedly retain the right to change the coaching staff where necessary.

2. Acceptance of Terms and Conditions.

2.1  All agreements relating to the teaching of the Course by Ultimate Vision Sports to the child are subject to these Terms to the exclusion of all other terms and conditions.

2.2  No variation or addition to the Terms shall be binding unless agreed in writing by Ultimate Vision Sports and the Parent.

2.3  The Terms shall be deemed to have been acknowledged and accepted by the Parent or Carer upon payment of the Fee by or on behalf of the Parent. 

2.4  The Parent and/or Carer agrees to keep the content of the Ultimate Vision Sports provision confidential and not to copy or use any aspect of the Ultimate Vision Sports directly or indirectly.

2.5  The Parent and/or Carer agrees not to directly or indirectly manage, operate or assist in the organisation of any business which competes with Ultimate Vision Sports while the Pupil is a member of Ultimate Vision Sports and for a period of two years afterwards.

3. ACCEPTABLE USE OF THE SITE

3.1  We insist that any use by you of the Site shall be in accordance with the following conditions:

3.2  You must not post onto or otherwise make available on the Site any defamatory, threatening, obscene, harmful or pornographic material or material which would violate or infringe in any way the rights of others (including intellectual property rights, rights of confidentiality, or rights of privacy) or cause distress or inconvenience or which does not comply with all relevant laws. You must not express opinions that are vulgar, crude, sexist, racist or otherwise offensive. Always treat other users with respect.

3.3  You shall not post onto or otherwise make available on the Site any material which you do not own without the express permission of the owner of the material.

3.4  You may not copy, download, reproduce, republish, broadcast, transmit in any manner whatsoever, any content except as is strictly necessary for your own personal non-commercial use.

3.5  When accessing and using this Website, you shall comply with all applicable laws and regulations in the country from which you access the Website.

4. Bookings

By booking a place for your child on any course you agree to these Terms and Conditions.

4.1  Ultimate Vision Sports offers an online booking service, once the booking form has been completed and submitted, and the booking validated by Ultimate Vision Sports you will be sent confirmation of your booking REQUEST via the email address you have provided. Once your request has been confirmed you will need to make the full payment to the bank details Ultimate Vision Sports provide you with. Bookings are subject to these Terms and Conditions together with our website terms and conditions which are hereby incorporated.

4.2  Receiving email or text message acknowledgement of payment is confirmation of your request to book a child on a Ultimate Vision Sports course.

4.3  For safety reasons we can only guarantee a place on ANY course to those booking in advance. Those that arrive on the day will not be guaranteed a place on the activity.

4.4  Please ensure that your child can attend the course/event before you book onto any course. It is the parents/carers responsibility to ensure that the child meets the conditions for the course as listed on our publications.

4.5  Ultimate Vision Sports may cancel the agreement between the Parent/Legal Guardian and Ultimate Vision Sports at any time before the Course for any reason whatsoever.  Ultimate Vision Sports shall not be liable for any loss or damage whatsoever arising from such cancellation.

4.6  In the event of cancellation by Ultimate Vision Sports prior to the commencement of the Course by the child, Ultimate Vision Sports will refund any fees for outstanding classes within 30 days.

5. Fee and Payment.

5.1  The Parent shall pay the whole Fee to Ultimate Vision Sports prior to the Pupil commencing the sports Course.

5.2  The Fee is non-refundable under any circumstances whatsoever except with the prior written agreement of Ultimate Vision Sports.

5.3  Ultimate Vision Sports accepts credit/debit card as methods of payment but all credit/debit card payments are subject to a £1.00 processing charge which will be added to your booking.

5.4  If classes are cancelled as a result of an “Act of God” (e.g. disruption resulting from extreme weather conditions, earthquakes, etc), strikes, terrorist activity, or where local authorities/public guidance advise that delivery should be temporarily suspended for health or other reasons, then no refunds will be given and it will not be transferred to additional courses.

5.5  When paying via bank transfer online, we will accept: 

Visa Credit.
Visa Debit.

Parents or legal guardian should provide written consent for any child below the age of 16 who is attending a course delivered by Ultimate Vision Sports.

6. Discipline.

6.1  In the event that Ultimate Vision Sports determines the behaviour of the Pupil and/or the Carer to be unacceptable, Ultimate Vision Sports shall be entitled to exclude the Pupil and the Carer (or either of them) from Course and Venue permanently or for such period as Ultimate Vision Sports shall (in its entire discretion) determine.

6.2  The standard of behaviour which is to be regarded as unacceptable at a Course or at the venue shall be determined by Ultimate Vision Sports.

7. Child Protection

All Ultimate Vision Sports staff hold current child protection and DBS certification. In the event that a child makes a disclosure or a member of staff believes that the child is suffering from abuse we will act in accordance with our child protection policy, a copy of which is available on request from Ultimate Vision Sports management. If a disclosure is made or a member of the Ultimate Vision Sport’s staff member is concerned about a child being abused and this happens on a school premises, then the Child Protection Officer for that establishment will be informed as a matter of urgency.

8 Film/Photography and Privacy

8.1  Ultimate Vision Sports may from time to time take photographs/film of any Ultimate Vision Sports course/event, the use of this data is solely for the purpose of promoting and publicising Ultimate Vision Sports literature, website, press and TV, and for use with partners that Ultimate Vision Sports directing manager deems appropriate.

8.2  Parents/guardians that do not wish for their child to be photographed/filmed must make Ultimate Vision Sports aware of this at the time of booking or in writing before the Course starts (where possible Ultimate Vision Sports will inform parents/guardians at the start of a course).

8.3  Ultimate Vision Sports will hold all personal data in accordance with the Data Protection Act.

8.4 We shall comply with applicable UK Data Protection legislation from time to time in place in respect of any User Information.

9. SAFETY

9.1  When using the Site, in particular any chat forums or comments, you should always take the following precautions:

9.2  Keep Your identity private. Do not give out your full name, postal address, telephone number, e-mail address, the name of your workplace or school or any other information (other than that specifically requested by us), that could help someone discover your actual identity;

9.3  Never get together with someone you meet online.

9.4  Do not reply to any messages that are hostile, rude or inappropriate, or in any way make you feel uncomfortable. Instead, let us know about them by emailing us or contacting us directly.

10. Parent's Responsibility.

10.1  The Parent permits and represents that:

10.2  When attending the Course, neither the Child nor the Carer will be suffering from any contagious illness, disease or anything similar there to.

10.3  The Parent recognises and accepts that the Child shall be deemed to be under the direction, care and control of the Carer throughout the Course and the Carer shall be responsible for the welfare and behaviour of the Child throughout the Course and while the Pupil is at the Venue.

10.4  The Parent shall insure and keep indemnified Ultimate Vision Sports against all loss (including loss of profit), liability, costs and expenses which Ultimate Vision Sports shall incur directly or indirectly as a consequence of any action or inaction of the Parent, the Carer or the Child.

10.5  You agree to indemnify us, and/or any of our affiliates and our and their officers, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these Terms and Conditions by you or any other liabilities arising out of your use of the Site.

11. Promotions

11.1  Ultimate Vision Sports from time to time offers promotions, in the event that you have been issued with a promotional fee, this must be acknowledged and shared with the Ultimate Vision Sport’s Booking Team, this needs to be used in accordance with both the terms and conditions of that promotion and these Terms and Conditions.

12. Communications

12.1  We may send you communications via email, text messenger and literature.

12.2  You may visit our facebook page to receive up to date information regarding Ultimate Vision Sports.

12.3  You may visit our twitter feed to receive up to date information regarding Ultimate Vision Sports.

12.4  Other ad hoc correspondence, selected by us, to inform the Parents/Carers/Legal Guardians of any course or event which will be delivered by Ultimate Vision Sports.

13. Liability and Limitation of Liability

13.1  Neither us, nor any of our directors, employees or other representatives will be liable for damages, in contract, tort or otherwise including negligence, arising out of or in connection with the use of the Digital Service. You confirm that we shall not be liable to you or any third party for any modification to, suspension of or discontinuance of the Digital Service. This limitation of liability (to the extent permitted by law) applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

13.2  We do not limit or exclude our liability for death or personal injury resulting from our negligence.

13.3  Ultimate Vision Sports has Public Liability insurance with cover provided by Protectivity Insurance.

13.4  Other than in relation to death, personal injury, or property damage, where Ultimate Vision Sports or its staff is proven to be negligent, Ultimate Vision Sports liability to you is limited to the booking fee paid by you.

13.5  Content which is posted on any Ultimate Vision Sports communications is written or produced by users and we are not responsible for and give no endorsement of such content. We reserve the right to monitor the contributions and may respond to or comment upon communications by you and edit, refuse to post or remove any content from any bulletin boards and chat forums in our absolute discretion. No failure to remove particular content constitutes an endorsement or acceptance of it by us.

13.6  To the extent permitted by law, we make no warranties, express or implied, as to the content or the accuracy, timing or reliability of any information or statements contained therein, or statements, advice and opinions given by users on the bulletin boards and chat forums which are those of such users only. We neither endorse nor shall be held responsible for the reliability or accuracy of the same and we are not responsible in any way for any injury, loss or damage which occurs as a result of an opinion expressed or information provided on the Site. If you have any claim arising from the actions or statements of another user, you agree to pursue such a claim only against that User and not from us.

13.7  We will endeavour to provide the Site using all reasonable care. To the extent permitted by law, we exclude all implied warranties as to quality, accuracy or fitness of the content and we do not warrant that the content, any of the functions contained in the Site and the server will operate without interruption or delay or will be error free, free of viruses or bugs or is compatible with any other software or material.

13.8  We reserve the right, at any time, to modify, alter, or update these Terms and Conditions, and you agree to be bound by any such modifications, alterations or updates which are posted on the Site.

13.9  We shall not be liable in contract, tort, negligence or otherwise for any loss or damage whatsoever in any way connected with your use of the Site, whether direct or indirect, including, damage to software or hardware, damage for loss of business, loss of profits, or any other consequential loss. Nothing in these terms or conditions shall exclude or limit our liability for death or personal injury resulting from the negligence of us, our servants, agents or employees. If this clause is unenforceable in whole or in part then our total liability to you for all damages, losses, claims and expenses shall be no greater than the amount paid by you, if any, for accessing this Website.

13.10  Ultimate Vision Sports, its coaches, servants, employees or agents accept no responsibility under any circumstances for any loss (consequential or otherwise), damage, expense or delay suffered or incurred by the Parent, the Pupil or any other party arising directly or indirectly or in any way connected with the attendance of the Pupil at the Course (or any part of it) or any other act or omission on the part of Ultimate Vision Sports or any of its coaches, employees or agents even if such act or omission is negligent.

13.11  The Parent agrees (for and on behalf of the Parent and the Pupil) that any claim by the Parent or the Pupil against Ultimate Vision Sports or any coach, employee or agent of Ultimate Vision Sports must be brought within 60 days of the event that gave rise to such claim. Any claim made thereafter shall be time-barred.

13.12  The Parent acknowledges, warrants and undertakes (for and on behalf of the Parent and the Child) that the maximum aggregate liability of Ultimate Vision Sports to the Parent and/or Child under these terms shall not exceed the Fee.

13.13  All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or exclude liability for death or personal injury caused by the negligence of Ultimate Vision Sports, its coaches, servants, employees or agents or affects the statutory rights of the Parent or Child.

15. THIRD PARTY WEBSITES

15.1  You acknowledge and agree that we are not responsible for the availability of any third party websites or material you access through the site, and do not endorse and are not responsible or liable for any content, advertising, products or services on or available from such Websites or material, nor for any damage, loss or offence caused, or alleged to be caused, by or in connection with use of or reliance on any content, advertising, products or services available on or available from such websites or material.

15.2  Any dealings between you and any advertisers or third party merchants found on or via the Site, including payment for and delivery of products, services and any other terms, conditions, warranties or representations, associated with such dealings, are solely between you and the relevant advertiser or merchant. You agree not to Ultimate Vision Sports liable for any loss or damage of any kind incurred as the result of any such dealings.

16. Programme Changes

16.1  In the event that Ultimate Vision Sports has to cancel a course for any reason, a credit note for the full value of the booking fee paid will be issued to the person who booked or alternative provisions to stage the course at another time will be arranged and confirmed to all, if you are unable to attend at the alternatively arranged time and confirm this to Ultimate Vision Sports, Ultimate Vision Sports will issue with a credit note to the full value of the booking fee paid.

16.2  In the event of inclement weather, all Ultimate Vision Sports courses have suitable indoor areas to change, meet and eat lunch, and suitable indoor activities will be organised to replace the outdoor activities at the discretion of Ultimate Vision Sports staff.

17 Leaving an Activity

17.1  Any child that is collected must be collected by a parent or guardian and such parent or guardian must sign the child out of the course with a member of Ultimate Vision Sports staff. Any child that normally walks home unaccompanied from any course will only be allowed to leave unaccompanied if a parent or guardian has provided written consent prior to the commencement of the Course/Event.

18. Personal Property

18.1  Ultimate Vision Sports cannot be held responsible for any loss or damage to any personal belongings whilst attending a Ultimate Vision Sports courses.  Please ensure that no valuables are taken to any venue by your children.

19. Health & Safety

19.1  A full risk assessment will be carried out before any activity takes place at a new venue. Ultimate Vision Sports staff hold a current emergency aid certificate issued by an appropriate body.

19.2  By agreeing to these terms and conditions you are providing consent for Ultimate Vision Sports staff to administer any and all necessary first aid to your child as required at any time.

19.3  For safety reasons it is compulsory for all attendees to wear shin pads on an Ultimate Vision Sports course which involves football, hockey or another contact sport.

19.4  Ultimate Vision Sports reserves the right to refuse permission to participate for any child not wearing shin protection.

19.5  It is the parent/guardian’s responsibility to ensure appropriate clothing is worn and/or available for their child for the course being undertaken and weather conditions.

20 Medical information

20.1 Any medical conditions that any participant may have must be fully disclosed (1) at the time of booking in writing to Ultimate Vision Sports at registration and (2) to the lead coach on the course or at the venue.

21. Complaints

21.1  In the unlikely event that you or your child are dissatisfied with the service we provide then please in the first instance raise it with the lead coach at the course. He/she will deal will the problem in accordance with our policies and procedures.

21.2  If the problem is not resolved to your satisfaction, then please write to our manager director sbush@ultimatevisionsports.co.uk within 7 days of child’s attendance on the course.

21.3  We take your views and complaints very seriously and will endeavour to resolve your complaint as quickly as possible. Refunds will only be issued if Ultimate Vision Sports is proven to be in breach of these Terms &Conditions.

22 EMAIL DISCLAIMER

Any emails and/or files transmitted with them are confidential and intended solely for the use of the individual or entity to whom they are addressed. If you have received any email in error please email management@ultimatevisionsports.co.uk immediately. Any opinions expressed in emails are those of the individual and not necessarily those of Ultimate Vision Sports. Although Ultimate Vision Sports has taken reasonable precautions to ensure no viruses are present in our emails, we cannot accept responsibility for any loss or damage arising from the use of this email or attachments.

23. General.

23.1  Any notices to be sent by either party to the other shall be sent by pre-paid recorded delivery or registered post or hand delivered to the address of the relevant party and shall be deemed to have been received by the addressee within 48 hours of posting if sent by post and immediately if hand delivered. Ultimate Vision Sports do not accept service of documents by email or fax.

23.2  The failure by either party to enforce at any time or for any period any one or more of the obligations arising under these Terms shall not be a waiver of them or of the right at any time subsequently to enforce all the obligations arising under these Terms.

23.3  The Parent, in agreeing to the terms of this contract, consents to the their data being shared with other companies in the Ultimate Vision Sports.

23.4  These Terms constitute the entire agreement between the parties hereto and supersede all prior agreements and understandings between the parties. It is agreed that no statement, promise or inducement whether written or oral alleged to have been made by either party and which is no contained herein shall be binding or form part of this Agreement.

23.5  This entire agreement shall be governed by English Law and shall fall under English jurisdiction. For Republic of Ireland based courses, this entire agreement shall be governed by Republic of Ireland  Law and shall fall under Republic of Ireland jurisdiction.

24. Information

24.1  The information on this site is updated regularly. However, we hereby exclude any warranties (whether expressed or implied) as to the quality, accuracy, efficacy, completeness, performance, and fitness for a particular purpose of the site.

24.2  These Terms and Conditions form the entire agreement between you and Ultimate Vision Sports

24.3  By booking a course with Ultimate Vision Sports you are acknowledging your full acceptance of these Terms and Conditions and confirm that you have not relied on any other representation other than those contained within these Terms and Conditions.

24.4  If any term within these Terms and Conditions is found to be unenforceable by a competent Court then such term shall be struck out but the remaining terms within these Terms and Conditions shall continue in force to the full extent permitted by law.

24.5  These Terms and Conditions are governed by English law and subject to the exclusive jurisdiction of the Courts of England.

25. Cookies

A cookie is a small file and holds a certain amount of data, which our website can send to your browser. It may then be stored on your computer's hard drive and can be accessed by our web server. This cookie data can then be retrieved and can allow us to customise our web pages and services accordingly. It's important to clarify that cookies do not collect any personal data stored on your hard drive or computer.

Ultimate Vision Sports will not use cookies to collect personally identifiable information about you. However, should you choose to disable, reject or block our cookies, some parts of our website may not function fully.

There are two types of cookie used on this site:
